Terms & Conditions
1. All services provided by the Mini Sports Club Ltd(“Mini Sports Club”) are subject to these terms, which may be changed by Mini Sports Club in any manner, and at any time, and any such changes will be notified to the Parent in writing by the Mini Sports Club .
2. The Parent acknowledges that by paying the fee, the parent has read, understood and accepted the terms set out in these terms and conditions and agrees to be bound by them.
3. The parent acknowledges that all proprietary information and material relating to the Mini Sports Club business, including the website is the intellectual property of the Mini Sports Club and to the extent that it is or contains confidential information such information and material is to be kept confidential at all times.
Fees & Payment
4. The fee must be paid by the parent to Mini Sports Club Ltd, without deduction prior to the pupil commencing the class or course.
5. The fee is non-refundable except where a pupil has attended an initial class of a course and the parent has given notice to the Mini Sports Club (within 24hrs of the pupil attending the initial class) that the pupil will not be continuing with the course, in which case the Fee will be refunded in full by the Mini Sports Club.
6. The Mini Sports Club will not be liable for any breach of this agreement (and will not be required to refund any part of the fee to the parent) in the event of a force majeure. Force majeure shall include failure or delay to provide the services as a result of extreme weather conditions, natural disaster, fire, flood or other causes whatsoever beyond the reasonable control of Mini Sports Club.
Cancellation
7. Mini Sports Club reserves the right to cancel a class or course (prior to the commencement of the class or course) for any reason whatsoever, including inadequate numbers. On this event, the Parent will be notified as soon as possible and Mini Sports Club will refund any Fee paid for the cancelled class or course.
Parents Responsibility
8. Neither the pupil nor the carer will be permitted to attend the class if suffering from any illness, infectious disease or anything similar that may harm or has the potential to cause harm to any other participant.
Indemnity
9. The parent hereby defends, indemnities and holds harmless, Mini Sports Club from and against all loss (including loss of profit), injury, liability damages, claims, costs and expenses (including legal expenses) which Mini Sports Club Ltd shall incur directly or indirectly as a consequence of any action or inaction of the parent, the carer or pupil (including negligence).
Discipline
10. In the event the Mini Sports Club reasonably determines the behaviour of the pupil and or carer to be unacceptable, Mini Sports Club Ltd shall be entitled to exclude the pupil and the carer (or either of them) from the class, course and the premises permanently, or for such period as Mini Sports Club Ltd shall (in its entire discretion) determine. In such circumstance Mini Sports Club shall not be obliged to refund the fee paid.
11. The standard of behaviour which is to be regarded as unacceptable at a class, course or on premises shall be determined by Mini Sports Club Ltd.
Exclusion of Liability
12. Mini Sports Club Ltd accepts no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay suffered or incurred by the Parent, the pupil or any other party arising directly or indirectly in anyway whether connected with: cancellation of a class or course : exclusion of the pupil or any damages or loss caused by the coaches, employees, agents or pupils of Mini Sports Club Ltd or any other person whatsoever to any property or person(whether similar to the forgoing or not).
13. The liability of Mini Sports Club Ltd to the parent or the pupil arising out of any claim for damages for any cause whatsoever will be limited to the actual damage or loss suffered by the parent or pupil, or the amount of the fee paid for the course, whichever is less.
14. No action may be brought by the parent or pupil more than two months after it became aware of the cause of action.
